Betty Yerger

 

Betty Yerger, 81, of Naples, FL, passed away on May 10, 2011 after a brief illness. She was born on May 5, 1930 in Pottstown, PA to the late Pearl and Norman Stetler.

Betty was an energetic and well-loved Naples resident for over 30 years. In addition to spending more than 44 years with Bell and United Telephone Companies, she was a devoted wife, mother, grandmother, and great-grandmother. Betty loved to travel, cook Pennsylvania Dutch food, and spend time with friends and family. She was a competitive Mahjong player and also was a member of Emmanuel Lutheran Church.

She is survived by her husband of 62 years, Daniel Yerger; her sons, Douglass (Kathy) Yerger of Pottstown, PA, and Dwight (Linda) Yerger of Naples, FL; her grandchildren, Mark (Laura) Yerger, Denise Tyler, Drew Yerger, and Dwayne Yerger; and one great-grandson, Cole Tyler.

A visitation will be held from 11:00 a.m. to 12:00 p.m. Monday, May 16th, followed by a funeral service at 12:00 p.m. at Hodges Funeral Home, 525 111th Avenue North, Naples, FL.

This time, we have a special request for all of you represented by Republicans:  write to them and ask for their support!  

 

Your action on this is extremely important -- the more letters we can get to Congress, the higher profile this issue will be for them.  

 

From past experience, we know that many Democrats will support this bill, so we need to encourage Republican members to get on board early.  Let's make this a truly bipartisan effort to do the right thing and protect retirees' earned benefits.

FREQUENTLY ASKED QUESTIONS (FAQs)

 

 

 

1.      WHAT DO I NEED TO DO NOW IN RESPONSE TO THE NOTICE?

 

         Fill out and mail back the Consent Form IMMEDIATELY.  To be included in the Age Discrimination part of the case, you must mail back the Consent Form in the prepaid, self-addressed envelope that came with the Notice.  If you mail it back by the deadline, your claim will automatically be part of the case.

 

         Also request the Questionnaire that you will complete and mail back so that the retirees’ legal team can review whether you also have another possible claim – for “Breach of Fiduciary Duty”.  This claim is described on Page Two of your mailing.  Your lawyers will review your completed Questionnaire and then discuss with you whether that claim can also be added to the case.

 

         Right now, you are only in the case as a Class Member for the claim to restore your retiree medical and life insurance benefits under just one part of the federal pension law.  To fully protect your rights with additional claims, you should:

 

o   (1) immediately mail back the Consent Form to join the age discrimination claim, and

 

o   (2) Press [Zero] and ask for, complete, and mail back the Questionnaire that we will send you so your legal team can review whether you can also make a claim for Breach of Fiduciary Duty.

2.      WHY SHOULD I MAIL BACK THE CONSENT FORM?

 

         Your lawyers are strongly urging you to mail the Consent Form to fully protect your rights in this case, and give you the best chance to receive the best outcome from this case.

 

         If you do not mail back a completed Consent Form, you can’t and won’t benefit from the claim for age discrimination under the federal Age Discrimination law.

5.      WHY SHOULD I ASK FOR A QUESTIONNAIRE ON THE BREACH OF FIDUCIARY DUTY CLAIM DESCRIBED ON PAGE 2 OF MY MAILING?

 

         The Questionnaire will provide your lawyers with the information they need to see whether you have a basis to make the additional claim for “Breach of Fiduciary Duty”.

 

         You may have a basis to make a claim for Breach of Fiduciary Duty if the Company made either oral or written statements that led you to believe that your medical and/or life insurance benefits from the company were for life or for your entire retirement.

 

         Your lawyers strongly urge you to request the Questionnaire, to fill it out promptly, and send it back as soon as possible.  Sending in both the Consent Form and requesting and returning your completed Questionnaire will protect all your rights in this case.
